Had Enough Yet America? Lets License Politicians

It seems like everytime I turn around there's some politician telling me what they think is "good" for me or trying to impose their will on me by legislating my civil liberties away! The irony is that these politicinas can't even manage their own (person or professional) lives yet they seem to think they have some divine right to dictate mine, and yours! Really?

The economy is in the tank - Washington spends money like college kids on spring break, illegals / drug dealers cross our borders / enter our County seemingly unchallenged, jobs are gone, gas prices sky rocket for no apparent reason, obama care being shoved down our throats, etc, etc..

When is enough, enough America? When did "We the People" sign over complete control of our personal and professional lives to the politicians? To my knowledge, we never did yet they seem tot think they own American and that "We the People" and nothing more than cattle for them to herd ... Not so much!

The America these criminals (aka politicians) are forcing upon us is NOT the America our founding Fathers envisioned and / or wanted and it's time "We the People" stand up, speak up, and send a CLEAR message to EVERY politician on EVERY level of Government that "We the People" OWN America and that THEY (politicians) work for us!

Case and point ... In my business I'm required to possess a State and Federal license (all this costs money by the way) To secure this licensing, I am required to submit to background checks, credit checks, fingerprinting, on going education, testing, etc, etc... It's INSANE how many hoops we have to jump through to earn a living & after we have, the politicians tell me how much I'm alloed to earn!! Outrageous!

I propose that "We the People" set up a licensing system for any / all politicians and that it applies to those already in office (including the President / Congress) and those aspiring to be in government on any / all levels!

"We the People" will apoint a civillian board to accetp and review applications .. The members of this board will be choosen at random (to prevent corruption) just as they select jurors and they will serve one one to two year terms. When their term is up, they leave and return to private life with NO perks, etc...

Existing and aspiring politicians will be required to register (for a fee paid out of their pocket!) themselves in a Nationwide database, submit to, and successfully pass criminal background, credit, and financial checks BEFORE they are allowed to continue on to the actual licensing process!

Application fee to be no less than $2500.00 - Non-refundable for any reason
Licensing Fee to be no less than $10,000.00 with a renewal fee of no less than $5000.00

Any / all applicants will be required to provide absolute, certified documented proof of their American citizenship BEFORE being allowed to continue / proceed - NO EXCEPTIONS! Any applicant with any ties to illegal aliens, terrorists, big corporations, etc will be automatically, and immediately disqualified -

After successfully passing the pre-screening process, politicians will then be required to take / pass (with a score of no less than 85%) 80 hours of continuing education - These courses will consist of American history, Constitutional law, economics, etc... I for one truly believe that any person in this Country aspiring to and / or currently holding any political office should be extremely well versed in how this Country was founded, the stuggles our founding Fathers endured, and why it's absolutely vital that that which they gave birth to is preserved, and protected and any and all costs!

A politician's license will carry a two yer life span, and must be renewed for a fee - Any / all licensing fees will be paid for by the applicants (no tax payer dollars will ever be utilized for this) and all moneys collected will be used to fund the civillian board of review - This will be a self sufficient, self sustaining system - PERIOD!

Upon application for renewal, ALL applicants political, personal, and financial records will be scrutinized to insure they reflect the highest stand of integrity / worthy of public trust - Renewal applications will be denied for financial irresponsibility, criminal offense's etc ... Renewal fees will NOT be refunded and the applicant will be disqualified from holding any public office for a period of at least 5 years and / or until they can redeem themselves before the American public.

Once a politicians term has ended, they will return to private life by default and do so without any "perks" - There will no longer be life long "golden parachute" style health insurance, benefits, secret service protection etc, etc.. Politicians will return to their former professions and EARN a living / pay their own way just like the people they took an oath to represent ..

Of course, my licensing idea needs fine tuned but it absolutely has merit ... Think about it, we as business people have to jump through the politicians hoops / be licensed to do practically anything! Who are they to think themselves exempt and / or unaccountable to those they serve??

Loan Modification success, failure, and complete confusion

Over the past few years, loan modification has become the predominant alternative to foreclosure or an option for those homeowners who simply cannot refinance for one reason or another.

The first, and most important thing to know about the modification process is that the banks DO NOT have to do it! It is not a “law” or an “entitlement.” The banks are under absolutely no formal obligation to offer any assistance what so ever. Lenders offer modifications as a means to remain profitable, and prevent financial loss. Period.

There is nothing “easy” about the modification process anymore.

Once upon a time before the Federal Government became involved, modification WAS “easy” as it was done on a case-by-case basis, and structured on the homeowner’s unique criteria. Trust me when I say I miss those “old days!” Back then we applied actual banking skills versus this generic garbage the Feds use! Success rates were much higher, and the process typically took less than 90 days start to finish. Today you’re lucky to get an approval in 6 months!

It is common knowledge the Governments HAMP program is a financial train wreck. Nationwide it maintains an approximate 88% FAILURE rate! Really? What, if anything can run at 88% failure and still operate effectively? Nothing.. Imagine if your car was running at 88% failure or if it was your heart…. Your car would be in the shop, and you’d most likely be in the hospital or worse!

There are so many twists and spins to loan modification that it’s impossible to offer any “typical” examples but the “basics” are all pretty much the same for any lender.

You must have a legitimate hardship

You must have a verifiable source of income

You must be able to document your income

You must provide a letter of “hardship”

Once you’ve compiled, and submitted your documentation package to the bank it becomes a waiting game. Always follow up with the bank to verify they’ve received ALL your documents, and they are being reviewed. Never “assume” anything.

After you’ve submitted your paperwork is when things start getting “tricky,” Your bank may not actually own your loan, and may just be servicing for another investor of Government agency. If this is the case, then your bank has very little power or authority to do much of anything other than forward your information on to the actual lien holder for review, and approval.

Should your bank be the lien holder also, odds are they will review your information for HAMP approval by default. Remember, HAMP is the Government program with an 88% failure rate…. HAMP determines whether you’re eligible or not based on your GROSS monthly income, not your net. A major mistake that causes epic failure for millions of people.

Long story short, never assume you’re “owed” a modification or that the Government program will help you as such an assumption could potentially cost you your home.

Also, don’t believe all the hype being promoted by the media and the Government. Not all private modification professionals are rip off artists. Truth be told, the scam artists represent a fraction of the industry. Most modification specialists are knowledgeable, honest, ethical professionals that genuinely care, and want to help you.

If you need to hire a professional, do your homework. You’re an intelligent person. If something sounds to good to be true, it is! You’re smart enough to recognize a scam artist when you hear or see one right?

Note: Attorneys have no “special” powers when it comes to modifications. The banks DO NOT fear them nor give them any preferential treatment

Professionals are entitled to be paid for their time, and expertise however; you should never pay anyone thousands of dollars for this service. I believe $1500.00 is a fair price considering all the time, and work involved. Personally, I’ve never charged more than $900.00 for my services, and I’ve never lost a clients home to foreclosure as a result of failure on my part!

Don’t be misled, use your brains, and do your homework!

First, let's address and acknowledge the facts ...

Across America foreclosure prevention and loan modification companies popped up like weeds once the rip off artists learned there was easy money to be made by preying on the misfortunes of others ..It's a sad reality but, it's fact.

Secondly, we as consumers need to clearly understand that not all of these companies / individuals are crooks! There are just as many (if not more) honest, ethical, legitimate professionals out here offering distressed homeowners genuine services - I know this because I am one of them, and I've NEVER cheated anyone in spite of being cheated by clients who refused to pay me for services rendered. Oh yes America, getting "burned" is a two way street only you never hear about it when we get cheated as there's no agencies we can complain to and / or report this crime..

Lately, there's been a lot of media coverage / publication regarding how no one should have to pay for professional help ..Nonsense! No one goes to work for free and certainly the banks / Government is not helping homeowners "free of charge" by any stretch of any one's imagination!

The banks, Government, and so called non profits are very well funded and compensated by OUR TAX DOLLARS for these alleged "free" services..so don't buy that lie! The truth is, "they" just don't like and / or want competition from the private sector! This is the reality and truth you will never be told or hear from the media ..

7.2 TRILLION (12 zero's) of OUR TAX DOLLARS are being passed around to banks and government sponsored "free" help agencies instead of being passed out to the tax payers who paid them and desperately need them given back!! Remember president Bush's "stimulus" checks? What a joke! I think I got around $400 bucks back after I paid in over $30k in tax's LOL .. I framed the check and hung it on my office wall as a joke!

Do the math ... there are approximately 300 million people in America - Divide 7.2 Trillion dollars by 300 million... That would give EVERY American approximately $2.4 million dollars each!! Do you think that would solve America's economic crisis? Damned right it would!

I'm digressing ...

All the media hype you see / hear is clearly being promoted (and paid for) by those who DON'T want to see all that money spread around and / or see America's people financially strong again .. Guess who these people might be...The banks? The Government? The Wall St. Power Brokers? The Federal Reserve? All of the above!

"HAMP Homeowner Bailout . . . money goes to banks, mostly

On November 30, Treasury finally began reporting how much it is actually paying out for foreclosure prevention to various banks and servicers (HAMP Incentive Payments 11-30-10). So far $728 million has been paid out to encourage mortgage modifications and prevent foreclosures. Of that total, less than $100 million has gone to homeowners. Nearly half the money was paid to servicers (mostly banks), and about 40% was paid to investors holding the mortgages (in many cases, banks). This relative trickle of homeowner bailout spending, one-tenth of one percent of the TARP bailout budget, turns out to end up mostly where the rest of TARP money ended up: going to the banks.

Meanwhile, the Congressional Oversight Panel's latest report finds that the Administration's foreclosure relief program has fallen woefully short of its targets, and concludes that the money set aside by Congress for homeowners may never get spent. The program's failure is partly due to bad program design, but also because Fannie Mae and Freddie Mac, charged with administration and enforcement of the HAMP contracts with banks, have failed in their roles. Better Business Bureau: Pay for Play? ABC Investigates

The Better Business Bureau, one of the country's best known consumer watchdog groups, is being accused by business owners of running a "pay for play" scheme in which A plus ratings are awarded to those who pay membership fees, and F ratings used to punish those who don't.

To prove the point, a group of Los Angeles business owners paid $425 to the Better Business Bureau and were able to obtain an A minus grade for a non-existent company called Hamas, named after the Middle Eastern terror group.

"Right now, this rating system is really unworthy of consumer trust or confidence," said Connecticut attorney general Richard Blumenthal in an interview to be broadcast as part of an ABC News investigation airing tonight on 20/20.

In an official demand letter sent to the national headquarters of the Better Business Bureau Thursday, Blumenthal called on the BBB to stop using its grading system, which he said was "potentially harmful and misleading" to consumers.

"The BBB accreditation and the BBB ratings systems is not about generating money," said BBB national president and CEO Steve Cox. He said the A minus grade for Hamas was given in error. "Plain and simple, we made a mistake," Cox told ABC News. Errors seem to abound at the Better Business Bureau.

As reported by an anonymous blogger the BBB also awarded an A minus rating to a non-existent sushi restaurant in Santa Ana, California and an A plus to a skinhead, neo-Nazi web site called Stormfront. Each listing cost $425. "They ran the credit card and within 12 hours they were an approved, accredited member," said the anonymous blogger, who runs a site called bbbroundup.com. "They're more interested in the money than their credibility," he said.

The BBB's Cox said the three listings were all mistakes made by sales people. "That's an inaccurate statement that business people are able to buy A's," Cox said. "We have more than 500,000 non-accredited businesses who have A ratings," he added. Yet, as part of the ABC News investigation, an ABC News producer with a camera was present as two small business owners in Los Angeles were told by Better Business Bureau tele-marketers that their grades of C could be raised to A plus if they paid $395 membership fees.

Terri Hartman, the manager of a Los Angeles antique fixtures store, Liz's Antique Hardware, was told only a payment could change her grade, based on one old complaint that had already been resolved. "So, if I don't pay, even though the complaint has been resolved, I still have a C rating?" Hartman then read off her credit card number and the next business day the C grade was replaced with an A plus, and the one complaint was wiped off the record.

In a second case, Carmen Tellez, the owner of a company that provides clowns for parties was also told she had to pay to fix her C- grade, based on a two-year old complaint that she says had already been resolved. The C minus became an A plus the very next day after she provided her credit card number for the $395 charge. "If I'm paying for a grade, then how are the customers supposed to really trust the Better Business Bureau?" she asked.

Cox said the examples provided by ABC News were violations of sales policy and not a standard way of doing business. "The BBB is not operating fraudulently," Cox said. In his demand letter to the BBB, the Connecticut attorney general said, "I am deeply concerned that certain BBB practices threaten its reputation and effectiveness as a reliable resource for consumers."

Allison Southwick, media relations manager for the BBB, said that the BBB had worked with Attorneys Geneal across the country, including Blumenthal, across the country to fight fraud. "We disagree with his characterization that BBB does not adequately disclose the fact that Accredited Businesses financially support BBB," said Southwick. "However, we are always interested in hearing from our partners in consumer advocacy and are pleased to accept constructive feedback from his office and other consumer advocates." Better Business Bureau Grading System The Better Business Bureau, a non-profit group that began 98 years ago, instituted its A plus through F grading system just two years ago, replacing a "satisfactory/unsatisfactory" ratings system.

Critics say the BBB has used the new grading system as part of an extensive tele-marketing campaign to increase membership and revenue. An ABC NEWS examination of filings with the federal government revealed that at least 25 of the Better Business Bureau's top officers had salaries in excess of $100,000. The head of the Los Angeles Better Business Bureau, William Mitchell, was paid more than $400,000, according to the Better business Bureau.

"I think the Better Business Bureau changed course and lost its way by adopting a system of pay to play that maybe enhanced its revenues but also greatly diminished its credibility and honesty," said attorney general Blumenthal, who was elected to the United States Senate from Connecticut last week. "It's very troubling and it could be illegal because the failure to disclose to consumers could well be deceptive and misleading," he added. The ABC News investigation found numerous examples of well known companies that are not members of the Better Business Bureau being branded with F grades, often apparently based on scant evidence or a small number of complaints.

The five-star Ritz Carlton Hotel in Boston was given a F rating after only two complaints. "A million customers served, two complaints resulting in an F rating, seems to be somewhat unusual, to say the least, " hotel general manager Erwin Schinnerl told WCVB-TV in Boston.

Celebrity chef Wolfgang Puck told ABC News that parts of his food and restaurant empire have received an F grade because he refused to pay to join the Better Business Bureau. "You know, if you become a member, you're sure to get an A, but if you don't pay, it's very difficult to get an A," said Puck, who has been a regular on the ABC News program "Good Morning America" since 1986. "I think where you have to join an organization to get a good grade is wrong," Puck said.

For too long we have been too complacent about the workings of Congress. Many citizens had no idea that members of Congress could retire with the same pay after only one term, that they specifically exempted themselves from many of the laws they have passed (such as being exempt from any fear of prosecution for sexual harassment) while ordinary citizens must live under those laws.

The latest was to exempt themselves from the Healthcare Reform ... in all of its forms. Somehow, that doesn't seem logical. We are not supposed to have an elite that is above the law.

I truly don't care if they are Democrat, Republican, Independent or whatever. The self-serving must stop. A Constitutional Convention is a good way to do that!

It is an idea whose time has come, and in this writers opinion, is FAR overdue!

With the advent of modern communication, the process can be moved along with incredible speed. There is talk out there that the "government" doesn't care what the people think which is absolutely irrelevant, as their personal opinions mean NOTHING versus those of "We the People"

It is incumbent on the (that's us by the way)population to address elected officials to the wrongs afflicted against the populace. Think about this...The 26th amendment (granting the right to vote for 18 year-olds) took only 3 months & 8 days to be ratified! Why? Simple! The people demanded it. That was in 1971...before computers, before e-mail, before cell phones, etc.

Of the 27 amendments to the Constitution, seven (7) took 1 year or less to become the law of the land...all because of public pressure.

I'm asking EVERY AMERICAN (illegals don't count!) forward this posting to a minimum of 20 (or more) people they know and in turn, ask them to do likewise.

In three days, most people in The United States of America will have the message!!

Spiritually? No.. . . Because when we declare 'one nation under God,' The Christian's God is loving and kind, while Allah is NEVER referred to as Heavenly father, nor is he ever called love in the Quran's 99 excellent names.

Therefore, after much study and deliberation.... Perhaps we should be very suspicious of ALL MUSLIMS in this country. - - - They obviously cannot be both 'good' Muslims and good Americans.

Call it what you wish it's still the truth. You had better believe it. The more who understand this, the better it will be for our country and our future. The religious war is bigger than we know or understand. ....

Edward "Ed" Mezvinsky, born January 17, 1937, is a former congressman. A Democrat, he represented Iowa's 1st congressional district in the United States House of Representatives for two terms, from 1973 to 1977.

In March 2001, Mezvinsky was indicted and later pleaded guilty to 31 of 69 charges of bank fraud, mail fraud, and wire fraud. Nearly $10 million was involved in the crimes.

Shortly after his indictment, he was diagnosed with bipolar disorder, but the judge at his trial disallowed a mental illness defense.

Credit repair is like a game of cat and mouse. Our job as credit repair experts is to know how, where, and when to set up, and spring the traps.

Credit Reporting Agencies, Collection Agencies, Banks and Credit Card companies get sued 1000's of time per year.

The majority of the lawsuits filed are born out of incompetenace, laziness, and neglect. The collection agencies, banks, credit reporting agencies and credit card companies consistently report inaccurate, unverifiable and outdated data. Reporting of inaccurate, outdated and unverifiable data is a violation of several laws and acts however, as they assume the public is to ignorant to know the law and their rights, and that there's no real agency "watch dogging" their actions, they simply do what they want and / or don't bother.

The FCRA (Fair Credit Reporting Act), FACTA (Fair and Accurate Credit Transactions Act), FCBA (Fair Credit Billing Act), HIPPA (Health Insurance Portability & Accountability Act) all have consumer protections and special provisions that deal specifically with collection agencies, credit reporting agencies, original creditors and / or medical providers.

Understanding which of these numerous, complex laws apply to which situation is EXTREMELY important BUT also very confusing.

For example: If you were to send a letter to a collection agency stating that they have violated the "XYZ" consumer protection act and the must comply within "X" amount days or a formal complaint will be filed using an incorrect statute your dispute will be useless, and a waste of time, energy, and resources. This is a common error made by many so called "credit repair" professionals .. It's a sad reality but many of these credit repair, loan modification, debt consolidation companies hire inexperienced, unqualified sales people (who work for much less than a credentialed professional) to "sell" and work their files ..Like the credit agencies they pursue, they too are often lazy, incompetent, and motivated by profits ..

Thinking about these and other statements made by the man who wears the title of president. I keep wondering what country he believes he's president of.

In one of my very favorite stories, Edward Everett Hale's "The Man without a Country," a young Army lieutenant named Philip Nolan stands condemned for treason during the Revolutionary War, having come under the influence of Aaron Burr. When the judge asks him if he wishes to say anything before sentence is passed, young Nolan defiantly exclaims, "Damn the United States ! I wish I might never hear of the United States again!"

The stunned silence in the courtroom is palpable, pulsing. After a long pause, the judge soberly says to the angry lieutenant: "You have just pronounced your own sentence. You will never hear of the United States again.. I sentence you to spend the rest of your life at sea, on one or another of this country's naval vessels - under strict orders that no one will ever speak to you again about the country you have just cursed."

And so it was. Philip Nolan was taken away and spent the next 40 years at sea, never hearing anything but an occasional slip of the tongue about America. The last few pages of the story, recounting Nolan's dying hours in his small stateroom - now turned into a shrine to the country he fore swore - never fail to bring me to tears. And I find my own love for this dream, this miracle called America , refreshed and renewed. I know how blessed and unique we are.

Reading and hearing the audacious, shocking statements of the man who was recently elected our president - a young black man living the impossible dream of millions of young Americans, past and present, black and white - I want to ask him, "Just what country do you think you're president of?"

You surely can't be referring to the United States of America, can you? America is emphatically a Christian nation, and has been from its inception! Seventy percent of her citizens identify themselves as Christian. The Declaration of Independence and our Constitution were framed, written and ratified by Christians. It's because this was, and is, a nation built on and guided by Judeo-Christian biblical principles that you, sir, have had the inestimable privilege of being elected her president.

You studied law at Harvard, didn't you, sir? You taught constitutional law in Chicago? Did you not ever read the statement of John Jay, the first Chief Justice of the Supreme Court and an author of the landmark "Federalist Papers": " Providence has given to our people the choice of their rulers - and it is the duty, as well as the privilege and interest of our Christian nation - to select and prefer Christians for their rulers"?

In your studies, you surely must have read the decision of the Supreme Court in 1892: "Our lives and our institutions must necessarily be based upon and embody the teachings of the Redeemer of mankind. It is impossible that it should be otherwise; and in this sense and to this extent our civilization and our institutions are emphatically Christian."

Did your professors have you skip over all the high-court decisions right up till the mid 1900's that echoed and reinforced these views and intentions? Did you pick up the history of American jurisprudence only in 1947, when for the first time a phrase coined by Thomas Jefferson about a "wall of separation between church and state" was used to deny some specific religious expression - contrary to Jefferson' s intent with that statement?

Or, wait a minute . were your ideas about America's Christianity formed during the 20 years you were a member of the Trinity United Church of Christ under your pastor, Jeremiah Wright? Is that where you got the idea that " America is no longer a Christian nation"?
Is this where you, even as you came to call yourself a Christian, formed the belief that "America has been arrogant"?

Even if that's the understandable explanation of your damning of your country and accusing the whole nation (not just a few military officials trying their best to keep more Americans from being murdered by jihadists) of "not always living up to her ideals," how did you come up with the ridiculous, alarming notion that we might be "considered a Muslim nation"?

Is it because there are some 2 million or more Muslims living here, trying to be good Americans? Out of a current population of over 300 million, 70 percent of whom are Christians? Does that make us, by any rational definition, a "Muslim nation"?

Why are we not, then, a "Chinese nation"? A "Korean nation"? Even a "Vietnamese nation"? There are even more of these distinct groups in America than Muslims. And if the distinction you're trying to make is a religious one, why is America not "a Jewish nation"? There's actually a case to be made for the latter, because our Constitution - and the success of our Revolution and founding - owe a deep debt to our Jewish brothers.

Have you stopped to think what an actual Muslim America would be like? Have you ever really spent much time in Iran? Even in Egypt? You, having been instructed in Islam as a kid at a Muslim school in Indonesia and saying you still love the call to evening prayers, can surely picture our nation founded on the Quran, not the Judeo-Christian Bible, and living under Shariah law. Can't you? You do recall Muhammad's directives [Surah 9:5,73] to "break the cross" and "kill the infidel"?

It seems increasingly and painfully obvious that you are more influenced by your upbringing and questionable education than most suspected.. If you consider yourself the president of a people who are "no longer Christian," who have "failed to live up to our ideals," who "have been arrogant," and might even be "considered Muslim" - you are president of a country most Americans don't recognize.

Could it be you are a president without a, and should not have a Country?

This bill is essentially “screws” the retiring generation who often downsize their homes after retirement with the proceeds going to benefit those in America who’ve chosen NOT to work and / or subsidize the ever increasing illegal alien population …

These are FACTS my friends not “urban legends” and / or political mud slinging…How this for “Hope & Change?” Isn’t it nice to know that after you’ve worked hard all your life to achieve what was once known as the “American Dream” you’ll be excessively taxed, and that your hard earned tax dollars will simply be handed out to those who don’t care to contribute or enter our Country lawfully?

2011 W-2 Tax Forms and Obamacare

Title IX Revenue Provisions-Subtitle A: Revenue Offset "(Sec.9002). Requires employers to include in the W-2 form of each employee the aggregate cost of applicable employer-sponsored group health coverage that is excludable from the employee's gross income (excluding the value of contributions to flexible spending arrangements)."Starting in 2011-next year-the W-2 tax form sent by your employer will be increased to show the value of whatever health insurance you are provided. It doesn't matter if you're retired. Your gross income WILL go up by the amount of insurance your employer paid for. So you'll be required to pay taxes on a larger sum of money than you actually received.

Take the tax form you just finished for 2009 and see what $15,000.00 or $20,000.00 additional gross income does to your tax debt. That's what you'll pay next year. For many it puts you into a much higher bracket. This is how the government is going to buy insurance for fifteen (15) percent that don't have insurance and it's only part of the tax increases, but it's not really a "tax increase" as such, it is a redefinition of your taxable income.Also, go to Kiplinger's and read about the thirteen (13) tax changes for 2010 that could affect you.

Why am I writing / posting this? Because hard working, tax paying Americans have an absolute right to know the truth, and also because an election is coming in November.

I’m not trying to sway political opinion and / or endorse / support any political party but I am hoping to bring awareness to very real issues that will dramatically effect all tax paying Americans and bring potentially devastating financial consequences!

Please vote intelligently, do your homework, dig deeper than the political ad’s on TV and / or the constant automated campaign phone calls you’ll be receiving. So much for the “do not call list” eh?

Heart Broken

I've travelled back east this month and visited my old home town ..

I drove past my old house that I'd sold about 10 years ago .. a big, beautiful turn of the century home in an exclusive neighborhood on the coast of Lake Erie - I loved that old house, and loved living in it ...

To my astonishment, I found the house standing vacant, and in a state of bad disrepair ..The lawn was over grown, and looked like it's stood empty for quite some time ... Seeing this broke my heart, and almost brought tears to my eyes...

I put years of my life, and a lot of love into restoring that beautiful old home .. It was a grand place with beautiful wood work, wall sized fire places, antique fixtures, etc.. I can't comprehend how anyone could not / would not care about it..

The old place sits about 90 feet off the road on 2.5 acres. It's surrounded by large old trees, and a once beautifully landscaped lawn which my old dog "Wolf" loved to play on ..

Wolf was a "rescue" and had a rough life before coming to me.. She was an amazing animal. Highly intelligent, fearless, fiercely loyal, and an exceptional guard dog. The old house was her home, and I know she was happy there. When she died, I spread her ash's over the grounds so she'd always be, and have her home ...

As I stood in the driveway looking at what time, and neglect had done to our beautiful old home, I suddenly sensed Wolf's presence..Maybe it was the light or my mind playing tricks but, I could swear I saw her running in the yard, and standing in the place where the driveway gates once stood ..That was Wolf's spot - She'd sit for hours by / guarding those old gates. Knowing she's still "on patrol" would not surprise me -

Maybe it was the many happy memories that created Wolf's presence or maybe her spirit is still on guard ..I don't know. Either way, it felt good to "see" her again.

I walked to where the old gates stood, and called her name .. I told her I loved her, and thanked her for the many years of love, companionship, and loyalty she'd given. I told her she'd done her job well but that it was time for her to go to Heaven, and guard God's Gates..

(I know this all sounds "crazy" but if you knew that old house, you'd know that other spirits occupied it also .. I too was a skeptic but after living there, I became a firm believer)

I drove away with a piece of my heart left behind...There's an old saying of "you can't go home again" and perhaps this is true in the physical World but in my heart, and minds eye, my old home is still beautiful, and a place filled with many happy, warm memories..This is the memory I prefer / choose to keep.

Loan Modification HAMP -v- Conventional

Good morning

Today I'd like to clarify the differences between the Governments HAMP program, and what I consider "old fashioned" common sense banking AKA conventional modification

The other day, I had a client accuse me of "ripping him off" because his lender told him that all the work I'd done for him. they would have done for "free" ...

In the loose sense, yes..lenders will do this "free" of cost (although it's costing tax payers billions) however, it's not an "automatic" nor an "entitlement" ..The Federal programs still require a tremendous amount of work - Preparing the numbers (expense's versus debts) hardship letters, etc,etc.....it can quickly become very, very complicated and overwhelming for the average person ... Such was the case in the above mentioned client's case - Very complex.

This particular client went through a divorce, and to save the house from being taken / given to his ex wife, he convinced his elderly, retired Father to refinance the house into his name but leave (the Son) him on title only .. The Father did so thinking he was helping his son ..

Long story short, they found an out of State mortgage broker who threw them both under the bus in one of the worst loans I've ever seen ... NINA (no income / no asset verification) Interest payment only, adjustable rate with a payment (interest only mind you) totaling more than the Father makes per month in his retirement / social security ..To make matters worse (if that was even possible) this mortgage broker even tacked on a home equity line of credit!!

So now we have an 80 year old retired man living on a fixed income of less than $3k per month owning two homes with combined mortgage payments totalling over $5000 per month ..The Son is self employed which makes verifying his income a nightmare .. Are you starting to see the challenges?

The Son lives in the house but is not on the mortgage - Unbeknownst to me, the Father did not actually occupy the property, and lived in another house with his wife. Basically, the Son lied to me about this very important detail - Under HAMP, this scenario is an immediate dis qualifier as the homeowner MUST occupy the property - Period - No exceptions

The Father / Son hired me 6 months ago - The home was in serious default and was scheduled to be sold at auction within less than 3 weeks from the time we all first met ..The clock was ticking / and ticking fast - After meeting with my clients and gathering their paperwork, I returned to my office, immediately faxed their authorization form to their lender and began conversation with them -

Within less than 24 hours (and after sorting out financials / details, etc) I was able to get the lender to approve a 3 month trial program under HAMP.. Another minor miracle as using the Son's income to qualify was "iffy" but the lender allowed it - This immediately stopped the foreclosure sale, and "bought" (figure of speech) my client 3 more months to stay in their home.

During this time, I contacted our State's Attorney Generals office to pursue predatory lending charges against the broker who put this loan together, and threw my client's Father under the bus .. Rarely do I ring the predatory lending alarm but this loan was SO jacked up, it demanded an investigation ... The AG's office agreed, and opened a case - This postponed any foreclosure even longer -

While the AG's office was investigating, the lender was still working on the trial modification ..It was denied after the trial payment plan due to the lender learning the Father did not actually occupy the property - Another "surprise" for me -

The AG's office concluded their investigation and basically told my client's to hire private legal counsel blah blah blah ...Still uncertain why that investigation fell flat - I can only assume the lender has deep pockets, and very good lawyers ..

So..now I have a HAMP denial, and the AG's office dropping the ball ... The lender immediately reinstated the foreclosure sale date and scheduled it for two weeks into the future! Again, I'm on the phone with the lender, and their attorney's trying to put the fires out, and I did - The lender / their attorneys agreed to re-open the case, and re review it for a "conventional" modification - This review is still pending by the way -

The Father had had enough, and simply wanted out - As he's the only one on the mortgage, he's the only one that will feel the full impact of the foreclosure .. He asked me to put him in touch with a good Realtor to short sale the home, and I did ... This Realtor specializes in short sales and is very knowledgeable and reputable ..The Son NEVER followed up with the Realtor and left his Dad hanging ...I contacted the Father, and gave him the Realtors direct number & strongly suggested he bypass his Son, and meet with the Realtor himself ..Apparently the Son talked him out of it as my colleague told me no meeting has ever been arranged ...

The point of all of this is to demonstrate how much work actually goes into securing a HAMP modification ..Of course not all scenario's are this dramatic / complicated but, this one was a real roller coaster ride!

I also want to mention that all this work was done WITHOUT my being paid in full - I mobilized a small army of professionals to assist this client, and did so on the honor system .. I still haven't been paid for my work & doubt I ever will be - This client promised to pay me over one month ago ..Never happened - Phone calls went unanswered - voicemail messages ignored / un-returned - Excuses being made by the Parents etc,etc..

Now this guy's accusing me of "ripping him off" ...How convenient eh? What better way to get out of paying for services rendered than to cry "foul" and "victim" ..I've seen it many times before - It's sad - Unfortunately, there's no agency / organization I can go to and complain about being burned - I just have to suck it up

The point I'm driving at here is this ....

Although lenders will do this for "free" it's not as simple as just picking up the phone and asking nicely ...There is still a great deal of ground / preparation work that must be done, and even more monitoring work "babysitting" the lenders to insure they've recieved all the paperwork, understand what they are reading, and that nothing gets "lost" or falls through the cracks .. It seems like "babysitting" the banks has become the most challenging part of our work these days!

HAMP is not "guaranteed" nor is it an "entitlement" .. It's a Federal program with very complex guidelines / restrictions ..it is not a "freebie" or a "one size fits all" program - Not everyone qualifies equally -

Another point is this ...If you choose to hire a professional to do the work for you - Pay them! Just because the lender's assist for "free" does not mean professionals work for free! If you want it "free" ..do all the work yourself - I'm sure you'll quickly discover how difficult it really is!

Yes...there are scam artists preying on America's misfortunes, and consumers must be very careful / cautious HOWEVER, this applies equally to "us" - We too have been burned many times, and need to be cautious -

I am an honest businessman, and a credentialed, qualified, experienced professional - I do not / will not mislead any client into thinking our work is "easy" - I do not make empty promises or offer false hopes. I do all I can to make sure my clients fully understand what we are going into, and that we go into it "eyes wide open" -

Like any other professional, I'm entitled to be paid for my time, experise, and services .. No one works for "free" do they? Do you? Of course not ...Why would anyone expect us to?

What I'm saying here is that if you choose to hire representation, you should fully expect to pay them for their services!

People amaze me ...

Guy hires me 6 months ago to save his home from foreclosure with less than 30 days left on the auction date clock ..

I immediately run all the numbers, prepare the paperwork, submit it / contact his lender, and get him qualified for the HAMP program which automatically stops the foreclosue sale for 3 + months.

I then contact the Attorney Generals office to file a predatory lending complaint against this clients mortgage company - AG's office opens an investigation stalling any potential foreclosure for another few months ...

Meanwhile, the lender denies the client for HAMP after the (very common) after the 3 month trial ..Foreclosure sale date is reactivated and scheduled for auction in two weeks..

Again, I get lenders attorneys on the phone and get the modification case re-opened / under review for a conventional program ...Sale date's postponed until November ..

This client owes me money for my work and has been ignoring me for over a month ..

Today I get a text msg from him stating I ripped him off because this was something he could have done blah blah blah ... Right - I do all this work and when it's time to pay me, I'm the crook - Uh huh

Debt Consolidation / Credit Repair Rip Off's

Hello America

I'm writing today to issue yet another "warning" to you ....................

Today's warning is regarding another breed of predator / scam artist -

The "debt consolidation" companies.............. I never cease to marvel at what new ways these bottom feeders can contrive to extract money from consumers, and do so seemingly without care, concern not conscious ..

For the record, there are LEGITIMATE debt consolidation firms that genuinely do the job they've been hired to do, and help their clients but I'm not discussing them today .. Today I'm focusing on the ones that call consumers in need, create fictitious "payment plans" and then start deducting money from the client's bank account each month alleging it's going into a "savings / escrow" account which will then be used to pay creditors ... BULL!

These companies claim to be "saving" money for you and once they get enough to offer a settlement to your creditors, will pay it off ...What they DON'T tell you is that they are deducting their fees (monthly) from this alleged "savings" account and that they are making little to no effort to establish communication with your creditors!

Pay attention now ....Let's say you owe XYZ bank $10,000.00 on a credit card and that the "debt consolidation" company is deducting $250.00 a month from your bank account to transfer to the "savings / escrow" account they (or an affiliate bank of theirs) has allegedly established for you .. To pay the $10,000.00 in full it will take over 3 full years of "saving" ...Now let's say they are planning to offer XYZ bank a 50% settlement ...at $225.00 (deducting $25.00 for their service fee) it's going to take 1.85 YEARS to "save" the $5k!! Do you honestly believe XYZ bank is just going to sit there for 2 years with no payment, and do nothing???? Of course not! Odds are very good that XYZ bank will charge off your account within 4 months, and send you to collections, and then most likely SUE you! The "Debt consolidation" company that's been taking your money can DO NOTHING to stop and / or protect you from XYZ bank, and odds are even better, XYZ bank has never even heard of or from the company you hired to help you!!

Bottom line? You're basically "screwed" and have no legal leg to stand on!! - DON'T FALL FOR THESE SCAMS and / or HIRE THESE THIEVES!

Let's now move on to the "Credit Repair" companies that operate much in the same manner as the debt consolidation companies discussed above ....

They charge you a "down payment" fee and then a recurring monthly fee until the job is done ..I've seen some of these go on over a year!! I have been helping people fix their damaged credit for YEARS and I have NEVER seen it take longer than a couple of months!

Ok..so now you've been "warned" and know what to watch out for .... Debt consolidation / Credit repair are BOTH legitimate industries when handled by honest, credentialed professionals so don't assume it's all a scam - it's not

Do your homework before hiring anyone / company ..Don't rely solely on a BBB report as it may not reflect EVERYTHING you absolutely need to know...Call your State's Attorney General, Call the Federal Trade Commission, investigate licensing, etc ..

It's your money, and future! Protect it!

Foreclosure Prevention / Loan Modification Facts and Fiction

Today I'm writing on a subject I know a great deal about ... Foreclosure prevention and loan modification ..

First off, the programs created by the Government are (in my professional opinion) junk! Statistically, fed programs have a National failure rate of over 88%! It boggles my mind that our elected officials in Washington create / continue pursuing such garbage but...they do - So please don't rely solely on the Feds and / or think their programs are the only ones available

Everyone needs to understand that there are no "magic wands" when it comes to loan modification / foreclosure prevention ..It's all about business, and what makes sound financial sense for both lender and homeowner - Don't be misled by these scam artists 1 - 2% interest rates and / or claiming to be "attorney backed" ...I've been doing this along time, helped many hundreds of homeowners Nationwide and NOT ONCE have I ever had need for an attorney - So don't buy into that nonsense unless of course you have a legitimate, solid case to fight / defend against the banks .. Anything else will prove an expensive lesson in futility -

Also beware of the "snake oil" salesman ...You know the type, smooth talking with the "to good to be true" offer ... Use your heads, and trust your instincts! If it sounds to good or shady, RUN!

Foreclosure is stressful but don't ever let that stress over ride your intellect - When these people call, challenge them! Ask questions! Request documented evidence of their credentials, experience, success ratio's etc...Don't just take their word for it and certainly don't be misled into a false sense of security by a BBB (Better Business Bureau) rating! The BBB is NOT a regulatory, licensing or legal enforcement agency...

Dig deeper before shelling out your hard earned money!

I don't care what anyone says ...not just anyone can modify a loan successfully ...it's a complicated, complex procedure that requires a sound working knowledge of the mortgage banking / lending industry ...Trusting it to just anyone is just plain dumb and will most likely cost you your home ...

This all being said, let me also state that "expensive" doesn't always define better ... it does not cost thousands of dollars for professional modification help ..I've been doing it successfully for years and have never charged over $800.00 ...Granted, the service we provide is valuable, and we are skilled, degreed, credentialed professionals but that doesn't give us a license to steal ...

It all breaks down to knowing what you're doing, and getting the job done correctly, and as quickly as humanly possible ...

Don't fall for the fairy tales ... If you need professional help, hire a REAL professional ..very simple

Credit Problems and "repairing them

I've been a mortgage / credit professional since 1994. over the years I think I've probably seen it all from "zero" down payments to the realtors pushing the interest only "more house for less money" garabge ... Funny how when it crash's in on them, they all run for cover, and satrt pointing their fingers of blame at the mortgage brokers ..

The truth of the matter is this, NO mortgage broker can pull off a "shady" deal without a shady appraiser, a shady realtor, and a shady title / escrow company - This is reality and anyone trying to make you believe otherwise is nothing but a stone cold liar ...

The "Big" banks are jumping on that bandwagon also BUT, what American consumers don't know (but need to) is that the loans causing all the havoc were in fact created by, and promoted by the "big banks"... Mortgage brokers sold what they were provided ..Period!

Don't get me wrong, there are alot of mortgage brokers out there that should be tarred & feathered along with many Realtors, appraisers & escrow officers too .. Everyone's to blame equally ... Don't fall victim to hype or propaganda from the cowards unwilling to accept their responsibility and / or accountability -

All this being said (and the subject I was leading to) the new "American dream" reality is that people with poor credit will no longer be able to secure mortgage (or any other type) financing
the way they did just a year or so ago. The days of 100% subprime loans are gone, and people will now be "forced" to improve their credit scores -

There are many ways to improve credit scores.. paying your bills on time, living within your means, not becoming over extended, etc,etc being the most traditonal - Living in a perfect World, these methods would always work, and people would always have perfect credit however, the World is not perfect, and bad things happen to good people all the time! Unemployment, divorce, business loss / failure, etc..there are many things that no matter how diligently a person protects their finances...

Enter the Credit Repair industry ....

Contrary to popular belief (or what the lenders would have you believe) Credit "repair" is completely legal, legitimate, and if done correctly, and effective tool to help consumers correct errors and improve their credit scores dramatically in a very short amount of time.

As a mortgage lender, I've been helping clients "repair" (I hate that terminology) for years with great success. Basically it breaks down to understanding the credit laws, and how to motivate the "Big 3" credit reporting agencies to correct their errors and outdated information .. It's not rocket science but does requite some technical knowledge, and a lot of patience ....

The "Big 3" credit reporting agencies are Experian, Trans Union, and Equifax ..Their information can literally "make or break" american consumers - The sad part is that historically, their information / reportings are not 100% accurate, and these inaccuracies can be devastating to a persons FICO scores and / or ability to obtain credit.

Beware the wolves in sheep's clothing!

Unfortunately, there are many low lifes out there professing to be able to work "miracles" regarding credit repair .. Bull! These guys are nothing but liars, thieves & con artists victimizing people with bad credit but preying of their emotions, and desperations -

There are no "magic wands" when dealing with the Big 3.. Yes, there are some new technologies to help speed things up a little but, the bottom line is that eventually, a live hman being has to review disputes, verify them as accurate, and manually update credit profiles ..that's just the way it is no matter how much money you pay someone -

Lately I've been seeing an increase of credit repair scams, and I believe this is directly related to the "mortgage meltdown" and the loss of ssubprime loans / lending .. BE CAREFUL!

There is no such thing as "24 hour" credit repair - PERIOD!
This is legally & logistically impossible - The Big 3 DO NOT & WILL NOT move that quickly

NO ONE has "secret, inside" information or is an "insider" at the bureaus -
Engaging in activity like that is a fast track to a Federal prison cell - Don't buy it!

"Buying" or "Borrowing" someone else's good credit history is point blank fraud, and under the Patriot Act can / will get you thrown in prison for a very long time - Not a good thing.

There are many other scams out there designed to do nothing more than seperate the consumer from their hard earned money - You DO NOT have to pay high prices for professional credit repair & truth be told, you can do it yourself for the cost of paper, ink, envelopes & postage -
